STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT requiring a non-client public protection and recovery fund to be administered by the supreme court.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Non-Client Public Protection and Recovery Fund.  Amend RSA 311 by inserting after section 13 the following new section:

311:13-a  Non-Client Public Protection and Recovery Fund.  The supreme court shall establish and administer a non-client public protection and recovery fund for the purpose of paying claims of non-clients, including those who claim restitution for being imprisoned unlawfully.  The supreme court shall collect a fee from attorneys, judges, and court clerks to fund the non-client public protection and recovery fund.

2  Effective Date.  This act shall take effect January 1, 2018.

The Judicial Branch was originally contacted on January 6, 2017 and again on January 18, 2017 for a fiscal note worksheet, which the Branch has not provided as of Monday, January 23, 2017.  

 

METHODOLOGY:

This bill establishes the Non-Client Public Protection and Recovery Fund for the purpose of paying claims to non-clients, including those who claim restitution for being imprisoned unlawfully.  This bill requires the Supreme Court to collect a fee from attorneys, judges, and court clerks to fund the new Fund.  The amount of additional revenue collected and new expenditures resulting from this bill cannot be estimated.
