STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT relative to emergency school building aid.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  School Building Aid; Deficiency in Structure or Operation of a School Building.  Amend 2015, 276:141, II(a)(2) to read as follows:

(2)  A structural deficiency in the function or operation of a school building or portion thereof presents a substantial risk to the life or safety of the occupants or other persons, and is more than a technical violation of the fire code, including the needed replacement of heat and hot water systems, and requires remediation prior to July 1, 2017.

2  Effective Date.  This act shall take effect upon its passage.

METHODOLOGY:

This bill adds “needed replacement of heat and hot water systems” to the allowable emergency waiver criteria that may be applied for under the suspension of new school building aid projects in 2015, 276:141, II(a)(2) (HB 2).   As of the date of this fiscal note, the Department of Education has received one application to which this bill would apply to and does not expect to receive any more before June 30, 2017.  The application’s total project cost is $8,340,000 of which the applicant would be eligible for a 40% award ($3,336,000), with $2,668,800 (80%) paid in FY 2017 and the remaining $667,200 (20%) paid upon project completion in FY 2019 (estimated to be the fall of 2018).  The Department estimates its current FY 2017 appropriation for school building aid has an additional $3,051,000 above need, which would allow for the FY 2017 payment of $2,502,000 without additional appropriation.  Any unexpended school building aid appropriation as of June 30, 2017 will lapse to the general fund.
