STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT repealing the sunset provision on the first responder's critical injury benefit fund.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  First Responder's Critical Injury Benefit.  Amend RSA 281-A:32-a, II to read as follows:

II.  Payments awarded under this section shall be subject to all other provisions of RSA 281-A.  Total compensation payments for all additional compensation claims paid under this section shall not exceed $125,000 per claimant.  [No payments shall be made after July 1, 2018.] Benefits paid under this section for all claimants shall not exceed $500,000 per biennium.

2  Repeal.  2014, 242:2, I, relative to the prospective repeal of the first responder's critical injury benefit, is repealed.

3  Effective Date.  This act shall take effect upon its passage.

METHODOLOGY:

This bill repeals the prospective repeal of June 30, 2018 of the first responder's critical injury benefit and provides for the benefit to continue in perpetuity.  The repeal of the repeal also maintains the appropriation language allowing the governor to draw a warrant from funds not otherwise appropriated to pay any claims made.  The bill continues to limit the benefits paid for all claimants to not exceed $500,000, with a total benefit per claimant not to exceed $125,000.  To date, the State has made two payments to claimants: $125,000 in FY 2015 and $125,000 in FY 2016.  Consequently, only $250,000 of payments may be paid in future years.  

 

The Department of Labor states that to the extent claims are made, general fund expenditures will increase.  The Department cannot estimate the number of claims that will be made in future years.
