STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seventeen
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; New Hampshire State Troopers. Amend RSA 99 by inserting after section 10 the following new section:
99:10-a New Hampshire State Troopers. Classified New Hampshire state troopers of the division of state police shall be paid in addition to their regular salary, a differential pay in the amount of $25 per week unless otherwise collectively bargained.
2 New Paragraph; State Police; Detail. Amend RSA 270:12-a by inserting after paragraph I-a the following new paragraph:
I-b. The director of state police is authorized to detail full-time or part time bureau of marine patrol officers for law enforcement and crowd control services for public and private events and for extra duty functions to be performed outside regular business hours and for which an outside entity will be reimbursing the department for the services. While performing such services, the officers may enforce all criminal and motor vehicle laws of the state on property adjacent to the body of water where the services or details are being performed. The commissioner of safety shall establish a detail rate for such assignments. The rate shall include compensation for the assigned officers plus reimbursement for the use of any boats or vehicles, employee benefits, and related overhead expenses.
3 Effective Date. This act shall take effect upon its passage.

METHODOLOGY:
This bill sets a rate for differential pay for state troopers and allows for the director of State Police to use officers from the Bureau of Marine Patrol for crowd control services. The Department of Safety states differential pay only pertains to troopers represented by the NH Trooper’s Association (NHTA) and does not include command staff or confidential sworn personnel. Since differential pay is currently part of the 2015-2017 NHTA collective bargaining agreement, the Department states this will not impact state expenditures.
This bill also requires the Commissioner of Safety to establish a detail rate for marine patrol detail assignments. Overall, there is no fiscal impact to the state as the rate established would consider all applicable costs for marine patrol officers working extra duty details, therefore detail reimbursement revenue collected would cover costs incurred. State restricted revenue and expenditures may increase under this bill, but the impact would be net zero.
