STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT relative to telemedicine services.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Medicaid Coverage for Telehealth Services.  Amend RSA 167:4-d, I to read as follows:

I.  In this section, "telehealth services'' shall comply with 42 C.F.R. section 410.78, except for 42 C.F.R. section 410.78(b)(4).  The use of the term "telemedicine'' shall comply with the Centers for Medicare and Medicaid Services requirements governing the aforementioned telehealth services.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

The bill allows Medicaid providers who practice in metropolitan areas to be reimbursed by Medicaid for telehealth services.  Currently, RSA 167:4-d, I references federal regulations governing Medicare services in order to define "telehealth services" for purposes of the state's Medicaid program.  This bill retains a portion of the Medicare definition, but removes a reference to a section of the federal regulation stating that an eligible beneficiary must be located in a rural area.   The Department of Health and Human Services states it is unable to provide a cost estimate due to the limited amount of time delivery of telehealth services to Medicaid beneficiaries has been available.  However, by removing the restriction on the delivery of telehealth services, the Department assumes the bill will result in an indeterminable increase in state Medicaid expenditures.  Program funding is 50 percent state general funds and 50 percent federal funds.
