AN ACT relative to certification for solid waste operators.

AMENDED ANALYSIS

 

This bill lengthens the time a solid waste operator certificate is valid from one year to 2 years.

 

This bill also exempts volunteer solid waste operators from the certification requirement.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT relative to certification for solid waste operators.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Certificates for Solid Waste Operators; Renewal; Volunteers Exempt.  Amend RSA 149-M:6, XIII to read as follows:

XIII.  Establish and administer a certification program for solid waste operators which shall include training courses, and may include testing.  The fee for certification shall not exceed $50 per attendee, and shall be deposited in the nonlapsing revolving fund established in RSA 21-O:1-a.  Certification shall be renewed [annually] every 2 years.  If the renewal fee is not submitted within 90 days after the certificate's expiration date, the certified individual's name shall be removed from the current status and the certification shall be deemed expired.  The department shall charge a late fee of 50 percent of the renewal fee in addition to the renewal fee if the renewal is received after the certificate's expiration date.  Volunteers who are under the direct supervision of personnel certified pursuant to this chapter shall be exempt from the certification requirement of this paragraph.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill increases the term for which a Solid Waste Facility Operator certificate is valid for from one year to two years with no change in the $50 certificate fee.  The bill also exempts volunteer solid waste facility operators from certification if they work for a certified operator.  Certification fees are deposited into the nonlapsing revolving fund established in RSA 21-O:1-a (Publication Fund).  Amounts in this fund in excess of $30,000 at the end of June 30 are deposited into the general fund as unrestricted revenue.  However, no funds have been transferred to the general fund in recent history.    

 

The Department of Environmental Services has estimated this bill will decrease certificate fee revenue as follows:

The Department indicates the number of volunters is negligible and most volunteers are currently exempt under administrative rules.  The Department would need to amend administrative rules, update forms, webpages, training schedules and databases.  The Department expects this would be done by existing staff at no additional cost, but assumes it would negatively impact other program development work.  There will be no impact on county or local governments because neither existing law or the proposed changes require county or local government to be certified or pay certification fees.
