AN ACT relative to adult changing stations in places of public accommodation.

ANALYSIS

 

This bill requires certain places of public accommodation to install and maintain at least one adult changing station for persons with a physical disability that is accessible to both men and women when the facility is open to the public.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to adult changing stations in places of public accommodation.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Places of Public Accommodation; Adult Changing Station for Persons with a Physical Disability.  Amend RSA 155 by inserting after section 39-d the following new section:

155:39-e  Public Accommodations Constructed After January 1, 2020; Adult Changing Station for Persons with a Physical Disability.  

I.  This section applies to any new building or facility proposed to be constructed specifically as a place of public accommodation on or after January 1, 2020.  This section also applies to any single renovation of an existing building or facility which is proposed to be constructed on or after January 1, 2025, if the cost of such renovation exceeds $10,000.

II.  A person, private firm, organization, or corporation that owns or manages a commercial place of public accommodation subject to this section shall install and maintain at least one adult changing station for persons with a physical disability that is accessible to both men and women when the facility is open to the public.

III.  A commercial place of public amusement with an enclosed restroom facility or other similar private facility with an adult changing table in use before January 1, 2025, shall be deemed to comply with this section.

IV.  A facility shall ensure that the entrance to each adult changing station has conspicuous signage indicating the location of the station, and, if the facility has a central directory, shall ensure that the central directory indicates the location of the adult changing station.

V.  For purposes of this section "adult changing station” means an adult changing table placed within an enclosed restroom facility or other similar private facility that is for use by persons with physical disabilities who need help with diapering.

VI.  This section shall also be enforced by the building inspector as provided in RSA 676:11-13.

2  Effective Date.  This act shall take effect 60 days after its passage.
