1 New Paragraph; Right-to-Know; Definitions. Amend RSA 91-A:1-a by inserting after paragraph I the following new paragraph:

I-a. "Chief executive officer" means any public employee, including, but not limited to, any police or fire chief, who is directly supervised by a public body.

2 Right-to-Know; Nonpublic Sessions. Amend RSA 91-A:3, II(a) and (b) to read as follows:

(a) Except as provided in subparagraph (b), the hiring, dismissal, promotion, or compensation of any public employee or the disciplining of such employee, or the investigation of any charges against him or her, unless the employee affected (1) has a right to a meeting and (2) requests that the meeting be open, in which case the request shall be granted.

(b) The hiring of any person as a public employee If the public employee is a chief executive officer, only the disciplining of such employee or the investigation of any charges against him or her shall be held in nonpublic session, unless the chief executive officer (1) has a right to a meeting and (2) requests that the meeting be open, in which case the request shall be granted.

3 Effective Date. This act shall take effect January 1, 2019.
