This bill requires the department of environmental services and the department of health and human services to establish a data sharing protocol regarding certain health and environmental information collected by each agency.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to data sharing between the department of environmental services and the department of health and human services.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; Data Sharing Between the Department of Environmental Services and the Department of Health and Human Services.  Amend RSA 126-A by inserting after section 74 the following new subdivision:

Data Sharing Between the Department of Environmental Services

and the Department of Health and Human Services

126-A:75  Data Sharing Between the Department of Environmental Services and the Department of Health and Human Services.

I.  The department of environmental services (DES) and the department of health and human services (DHHS) shall create a method by which the departments will be able to share certain health outcome and environmental data.  The data sharing shall include, but may not be limited to:

(a)  Health outcome data collected by DHHS from hospital inpatient and outpatient records, indexed by patient identification and patient address.

(b)  Health outcome data collected by DHHS from all claims data, indexed by patient identification and patient address.

(c)  Health outcome data collected by DHHS from vital records data, indexed by patient identification and patient address.

(d)  Health outcome data collected by DHHS from the Behavioral Risk Factor Surveillance System, indexed by patient identification and patient address.

(e)  Private drinking water sample analysis collected by DES, indexed by address and homeowner address and GPS coordinates.

(f)  Public and commercial water supply sample data, indexed by address and GPS coordinates.

(g)  Chemical data and site information for sites that active or inactive groundwater management permits and GPS coordinates.

II.  Nothing in this section shall require the disclosure of confidential or personally identifiable information otherwise protected by state or federal law.

III.  On or before September 1, 2018, the commissioner of the department of health and human services and commissioner of the department of environmental services shall develop a protocol for the data sharing required by this section and shall submit a report regarding its implementation to the speaker of the house of representatives, the senate president, the state library, and the commission to study environmentally-triggered chronic illness, established in RSA 126-A:73.

2  Effective Date.  This act shall take effect 60 days after its passage.
