ANALYSIS

 

This bill permits the commissioner of the department of corrections and the superintendent of a county correctional facility to appoint a designee to manage issues relating to the delivery of prohibited articles to prisoners.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to the delivery of articles to a prisoner in a state or county correctional facility.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

65:1  County Departments of Corrections; Delivery of Articles Prohibited.  Amend RSA 30-B:9 to read as follows:

30-B:9  Delivery of Articles Prohibited.  No person shall deliver or procure to be delivered or have in his or her possession with intent to deliver to a prisoner confined in a county correctional facility, or deposit or conceal in any building or upon any land appurtenant thereto, any article with intent that a prisoner shall receive or obtain it, or receive from a prisoner any article with intent to convey it out of said county correctional facility without the knowledge of the superintendent of the county department of corrections, or designee; nor shall any prisoner deliver or procure to be delivered or have in his or her possession, or deposit or conceal in any building or land appurtenant thereto, or convey out of any county correctional facility, any article without the knowledge of the superintendent of the county department of corrections, or designee.

65:2  State Prisons; Delivery of Articles to Prisoners.  Amend RSA 622:24 to read as follows:

622:24  Regulations.  No person shall deliver or procure to be delivered or have in his or her possession with intent to deliver to a prisoner confined in the state prisons, or deposit or conceal in or about the prisons, or in any building or upon any land appurtenant thereto, or in any vehicle entering the premises belonging to the prisons, any article with intent that a prisoner shall receive or obtain it, or receive from a prisoner any article with intent to convey it out of the prisons, or bring into or attempt to take from the prisons any article contrary to the rules and regulations established by the commissioner of corrections and without the knowledge and permission of the commissioner of corrections, or designee.

65:3  Effective Date.  This act shall take effect 60 days after its passage.
