ANALYSIS

 

This bill makes certain technical changes in the insurance laws relating to the corporate governance annual disclosure act, health maintenance organizations, and Delta Dental plan of New Hampshire.

 

This bill is a request of the insurance department.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to financial regulation technicals.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

36:1  Corporate Governance Annual Disclosure Act; Purpose and Scope.  Amend RSA 401-D:1, I(c) to read as follows:

(c)  Provide for the [financial] confidential treatment of the corporate governance annual disclosure and related information that will contain confidential and sensitive information related to an insurer or insurance group's internal operations and proprietary and trade secret information which, if made public, could potentially cause the insurer or insurance group competitive harm or disadvantage.

36:2  Health Maintenance Organizations; Examinations.  Amend RSA 420-B:10, I to read as follows:

I.  The commissioner shall make an examination of the affairs of any health maintenance organization and providers with whom such organization has contracts, agreements, or other arrangements as often as he or she deems it necessary, but not less frequently than once in every [3] 5 years.  All examinations shall be conducted at the expense of the health maintenance organizations.

36:3  Delta Dental Plan of New Hampshire; Definitions; Scope of Chapter.  Amend RSA 420-F:1, III to read as follows:

III.  Delta shall be governed by this chapter and shall be exempt from this title, except for the provisions of RSA 400-A:16, RSA 400-A:37, RSA 400-A:39, RSA 402-C, RSA 404-F, RSA 415:18, XVI, relative to continuation of coverage, RSA 420-G:11, II, II-a and III, and 1961, 345; provided, however, if any of the provisions of 1961, 345 are inconsistent with this chapter the provisions of this chapter shall prevail.  Delta and its agents shall be subject to the fees prescribed for health service corporations under RSA 400-A:29, VII.

36:4  Delta Dental Plan of New Hampshire; Examination.  Amend RSA 420-F:11, I to read as follows:

I.  The commissioner shall make an examination of Delta as often as he or she deems it necessary, but not less frequently than once in every [3] 5 years.  All examinations shall be conducted at the expense of Delta.

36:5  Effective Date.  This act shall take effect upon its passage.
