AN ACT relative to emergency medical services license and fine revenue.

ANALYSIS

 

This bill provides that certain fees and fines collected by the division of fire standards and training and emergency medical services shall be deposited in the fire standards and training and emergency medical services fund rather than the general fund.

 

The bill is a request of the department of safety, division of fire standards and training and emergency medical services.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to emergency medical services license and fine revenue.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Division of Fire Standards and Training and Emergency Medical Services; Disposition of Funds.  Amend RSA 21-P:12-a, II(h) to read as follows:

(h)  With the approval of the commissioner, accept in the name of the state any and all donations, fees for tuition, rents, services and any and all moneys and grants from any governmental unit, public agency, institution, person, firm, or corporation and receive, utilize, expend, and dispose of such funds subject to budgetary provisions, consistent with the rules of the department of safety and the purposes or conditions of the donations or grant, except for fees and fines collected pursuant to RSA 153-A:15 and RSA 153-A:22 which shall be deposited in the fire standards and training and emergency medical services fund established in RSA 21-P:12-d.

2  Bureau of Emergency Medical Services; Disposition of Funds.  Amend RSA 21-P:12-b, II(l) to read as follows:

(l)  With the approval of the commissioner, accept in the name of the state any and all donations, fees for tuition, rents, services, and any and all money and grants from any governmental unit, public agency, institution, person, firm, or corporation and receive, utilize, expend, and dispose of such funds subject to budgetary provisions, consistent with the rules of the department of safety and the purposes or conditions of the donation or grant, except for fees and fines collected pursuant to RSA 153-A:15 and RSA 153-A:22 which shall be deposited in the fire standards and training and emergency medical services fund established in RSA 21-P:12-d.

3  Emergency Medical and Trauma Services; Fees.  Amend RSA 153-A:15 to read as follows:

153-A:15  Fees.  The commissioner may charge a fee for licensure of an emergency medical service unit, an emergency medical service vehicle, or an emergency medical care provider.  [However, no fee shall be charged to a nonprofit corporation or volunteer association.] The sums obtained from fees charged for licensure shall be forwarded to the state treasurer to be deposited into the [general fund] fire standards and training and emergency medical services fund established in RSA 21-P:12-d.

4  Emergency Medical and Trauma Services; Administrative Fines.  Amend RSA 153-A:22 to read as follows:

153-A:22  Administrative Fines.  The commissioner, after notice and hearing, pursuant to rules adopted under RSA 541-A, may impose an administrative fine not to exceed $2,000 for each offense upon any person or entity licensed under this chapter who violates any provision of this chapter or rules adopted under this chapter.  Rehearings and appeals from a decision of the director shall be in accordance with RSA 541.  Any administrative fine imposed under this section shall not preclude the imposition of further penalties or administrative actions under this chapter.  The commissioner shall adopt rules in accordance with RSA 541-A relative to administrative fines which shall be scaled to reflect the scope and severity of the violation.  The sums obtained from the levying of administrative fines under this chapter shall be forwarded to the state treasurer to be deposited into the [general fund] fire standards and training and emergency medical services fund established in RSA 21-P:12-d.

5  Effective Date.  This act shall take effect July 1, 2018.

The Legislative Budget Assistant has determined that this legislation, as introduced, has a total fiscal impact of less than $10,000 in each of the fiscal years 2019 through 2022.
