AN ACT relative to quorum requirements under the condominium act.

ANALYSIS

 

This bill modifies the quorum requirement at a condominium unit owners meeting when a vote requires greater than a simple majority vote of those present.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to quorum requirements under the condominium act.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Condominium Association Meetings; Quorum.  Amend RSA 356-B:38, I to read as follows:

I.  Unless the condominium instruments otherwise provide, a quorum shall be deemed to be present throughout any meeting of the unit owners' association until adjourned if persons entitled to cast more than 33 1/3 percent of the votes are present at the beginning of such meeting.  The bylaws may provide for a smaller percentage, not less than 25 percent, or for a larger percentage for associations having fewer than 25 units; provided, however, that for meetings with a vote that is not a simple majority vote of those present and voting, a  quorum shall require the presence of at least one more unit owner or proxy than the number of votes needed to pass or reject any item on the agenda for the meeting.  This paragraph shall not apply if the condominium is comprised of time sharing interests.

2  Effective Date.  This act shall take effect 60 days after its passage.
