AN ACT relative to late fees and early payment discounts in manufactured housing parks.

ANALYSIS

 

This bill requires that manufactured housing parks not charge a late fee for payments within 7 days of the due date.  The bill also requires notice of early payment discounts and exceptions for tenants receiving monthly social security benefits.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to late fees and early payment discounts in manufactured housing parks.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraphs; Manufactured Housing Parks; Late Fees and Early Payment Discounts.  Amend RSA 205-A:6 by inserting after paragraph III the following new paragraphs:

IV.  No manufactured housing park owner or operator shall charge a late fee for any rental payment that is paid in full within 7 calendar days of the due date.

V.  Any discount in rent offered by a manufactured housing park owner or operator for early payment of rent shall be offered to any tenant who receives monthly benefits from the United States Social Security Administration if such tenant makes the full rental payment within 4 calendar days of the date the payment is due.  It shall be the duty of the tenant to inform the park owner that he or she is receiving monthly social security benefits and to provide reasonable verification thereof.

VI.  All manufactured housing park rules shall inform tenants of the opportunity, if any, to receive an early payment discount.  The rules shall include provisions regarding early payment discounts for recipients of monthly social security benefits as set forth in paragraph V.

2  Effective Date.  This act shall take effect 60 days after its passage.
