STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to regulation of consultants for operators of games of bingo and lucky 7.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Gaming Consultant; Defined.  Amend RSA 287-E:1 by inserting after paragraph VI-a the following new paragraph:

VI-b.  “Gaming consultant” means any individual or business entity who is hired by or otherwise receives compensation from a charitable organization to provide gaming related services including consultation, management, assistance with the operation of the bingo games or the sale of lucky 7 tickets, record keeping, filing forms with the commission, advertising, or security.

2  New Paragraph; Game Consultants; Rulemaking.  Amend RSA 287-E:3 by inserting after paragraph XVI the following new paragraph:

XVII.  The licensing procedure for gaming consultants.

3  New Paragraph; Game Consultants; License Fees.  Amend RSA 287-E:4 by inserting after paragraph II-a the following new paragraph:

II-b.  The license fee for a gaming consultant shall be $750 per year.  Such fee shall be submitted to the commission at the time the application is made and shall be refunded if the application is denied.

4  New Paragraph; Game Consultants; Rulemaking.  Amend RSA 287-E:18 by inserting after paragraph IV the following new paragraph:

IV-a.  The licensing procedure for gaming consultants.

5  New Paragraph; Game Consultants; License Fee.  Amend RSA 287-E:19 by inserting after paragraph III the following new paragraph:

IV.  The license fee for a gaming consultant shall be $750 per year.  Such fee shall be submitted to the commission at the time the application is made and shall be refunded if the application is denied.

6  New Paragraph; Game Consultants; Definition.  Amend RSA 287-D:1 by inserting after paragraph VIII the following new paragraph:

VIII-a.  “Gaming consultant” means any individual or business entity who is employed by a game operator employer, or hired by or otherwise receives compensation from a charitable organization to provide gaming related services including consultation, management, assistance with the operation of the gaming event, record keeping, filing forms with the commission, advertising, or security.

7  Game Consultants; Rulemaking.  Amend RSA 287-D:3, III to read as follows:

III.  The application procedure for games of chance licenses for game operators and gaming consultants.

8  Gaming Consultants; License Applications.  Amend RSA 287-D:3, IV to read as follows:

IV.  Information to be required on license applications for games of chance licenses for game operators and gaming consultants.

9  New Section; Gaming Consultants; Application Requirements.  Amend RSA 287-D by inserting after section 11 the following new section:

287-D:11-a  Gaming Consultant License Application; Specific Requirements.

I.  Any person or entity other than a charitable organization or its members that provides consultation, management, assistance with the operation of the gaming event, record keeping, filing forms with the commission, advertising, or security shall be licensed under this section.  In addition to the general requirements under RSA 287-D:5, a gaming consultant license application shall include, at a minimum, the following information provided that the lottery commission may, by rule, establish additional items to be submitted on the application form or attached to it:

(a)  The identity of the game operator employer or charitable organization for whom the applicant works.

(b)  A list of any other states in which the gaming consultant has been registered or licensed as a professional fundraiser, professional game operator, gaming consultant, or other similar position.

(c)  A statement of whether a registration or license listed in subparagraph (a) has been denied, suspended, revoked, or enjoined by a court or state agency, or if such proceedings are pending.

II.  Nothing in this section shall prevent a licensee from working for more than one game operator employer or charitable organization.  

III.  The gaming consultant license shall expire on the last day of the month of the licensee's birthday.

10  New Paragraph; Gaming Consultant; Fees.  Amend RSA 287-D:13 by inserting after paragraph VI the following new paragraph:

VII.  The fee for a gaming consultant license shall be $750 per year.

11  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill defines gaming consultants and establishes licensing provisions.  It is estimated there would be 30 gaming consultants seeking licensure under the provisions of this bill.  Based on the bill’s effective date and the stated $750 annual license fee, this will increase state Lottery Commission revenue by $22,500 per year, beginning in FY 2019.  Lottery and charitable gaming revenue is credited to the Lottery Fund, with net revenues after Lottery Commission expenditures being credited to the Education Trust Fund.  This bill is not expected to increase state expenditures.
