AN ACT relative to prescription drug rebate amounts.

ANALYSIS

 

This bill requires the insurance commissioner to select 25 prescription drugs and requires insurance carriers and pharmacy benefit managers to annually disclose the amount rebated from drug manufacturers offering rebate programs during the prior year.  Under this bill, the commissioner shall analyze the information and include it in the annual report required under RSA 420-G:14-a.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to prescription drug rebate amounts.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Health Care Coverage; Prescription Drug Rebates.  Amend RSA 420-G by inserting after section 14-c the following new section:

420-G:14-d  Prescription Drug Rebate Amounts.  

I.  The commissioner shall select 25 prescription drugs based on high cost and utilization and shall require insurance carriers and pharmacy benefit managers to annually disclose the amount rebated for such drugs from drug manufacturers offering rebate programs during the prior year.  The commissioner shall analyze the findings including, but not limited to, populations served, demographics of those receiving rebates, types of medication and diagnoses impacted, and the cost of medications with and without rebates.

II.  The commissioner shall include the findings in the annual report required under RSA 420-G:14-a.

2  Prescription Drug Rebate Amounts.  Amend RSA 420-G:14-a, VI(b) to read as follows:

(b)  The commissioner shall also include in the report an analysis of the findings under RSA 420-G:14-d.

(c)  The commissioner shall submit the annual report to the governor, the president of the senate, and the speaker of the house of representatives on or before November 1 of each year.

3  Effective Date.  This act shall take effect 60 days after its passage.
