AN ACT establishing a commission to study the performance of the Medicaid managed care program and making an appropriation therefor.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT establishing a commission to study the performance of the Medicaid managed care program and making an appropriation therefor.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Commission to Study the Performance of the Medicaid Managed Care Program.  Amend RSA 126-A by inserting after section 5-e the following new section:

126-A:5-f  Commission to Study the Performance of the Medicaid Managed Care Program; Established.

I.  There is established a commission to study the performance of the Medicaid managed care program.

II.(a)  The members of the commission shall be as follows:

(1)  Three members of the house of representatives, one of whom shall be from the health, human services and elderly affairs committee, appointed by the speaker of the house of representatives.

(2)  Two members of the senate, appointed by the president of the senate.

(3)  The commissioner of the department of health and human services, or designee.

(4)  A representative of the New Hampshire Medical Society, appointed by the society.

(5)  A representative of the New Hampshire Nurse Practitioner Association, appointed by the association.

(6)  A representative of the New Hampshire Hospital Association, appointed by the association.

(7)  A representative of the National Alliance on Mental Illness New Hampshire, appointed by the alliance.  

(8)  A public member who shall be a patient currently served by Medicaid managed care, nominated by the commissioner of the department of health and human services and appointed by the governor.  

(b)  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

III.(a)  The commission's study shall include, but not be limited to:

(1)  Evaluating the performance of the Medicaid managed care program, including costs of the program, quality of care, patient satisfaction, and health care provider satisfaction.

(2)  Comparing outside contracted managed care with other alternative payment models such as accountable care organizations or global payments.

(3)  Determining whether Medicaid managed care should continue in its current structure.

(b)  The commission may solicit information from any person or entity the commission deems relevant to its study.

IV.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named house member.  The first meeting of the commission shall be held within 45 days of the effective date of this section.  Five members of the commission shall constitute a quorum.

V.  The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the  senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2018.

2  Appropriation.  The sum of $150,000 for the fiscal year ending June 30, 2018 is hereby appropriated to the department of health and human services for the purposes of the commission established in section 1 of this act.  This appropriation is in addition to any other funds appropriated to the department of health and human services.  The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

3  Repeal; 2018.  RSA 126-A:5-f, relative to the commission to study the performance of the Medicaid managed care program.

4  Effective Date.

I.  Section 3 of this act shall take effect November 1, 2018.

II.  The remainder of this act shall take effect upon its passage.
