AMENDED ANALYSIS

 

This bill requires the department of health and human services to consult with foster parents before releasing their personally identifiable information, to make a representative of the department consistently available to foster parents, and to facilitate the foster parents' participation in court hearings.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to the role of foster parents.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; Foster Parents.  Amend RSA 170-E by inserting after section 50 the following new subdivision:

Foster Parents

170-E:51  Foster Parents.  When a child is placed in a foster home pursuant to a juvenile court order:

I.  The department of health and human services shall consult with the foster parent prior to the release of the foster parent's address, phone number, or other personally identifying information to the child's parent or guardian.

II.  The department of health and human services shall make a representative of the department available 24 hours a day, 7 days a week, for the purpose of aiding the foster parent in caring for the acute needs of the foster child.

III.  Pursuant to RSA 169-C:14, the foster parent shall receive notice of all court proceedings and may, at the court's discretion, attend such hearings and submit written or oral reports of the child's behavior, progress, and developmental needs.

2  Effective Date.  This act shall take effect 60 days after its passage.

AN ACT relative to the role of foster parents.

METHODOLOGY:

This bill requires that: (1) the Department of Health and Human Services consult with foster parents prior to release of their personal information; (2) the Department make a representative available 24 hours a day, seven days a week to address the acute needs of foster children in care; and (3) foster parents receive notice of court proceedings and, at the court's discretion,  be permitted to attend and provide information on the child's behavior and progress.  The Department states the bill will have no fiscal impact.
