AN ACT relative to liability of energy facility companies for damage caused by restoration projects.

ANALYSIS

 

This bill requires a certificate issued by the site evaluation committee to include a provision that the applicant guarantees funding for restoration efforts in the event of environmental damage caused by the facility, as determined by the department of environmental services.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to liability of energy facility companies for damage caused by restoration projects.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Site Evaluation Committee; Certificate; Liability for Environmental Damage.  Amend RSA 162-H:16 by inserting after paragraph VII the following new paragraph:

VIII.  A certificate shall require a financial guarantee to fund restoration efforts in the event construction or operation of the facility causes environmental damage as determined by the department of environmental services.

2  Effective Date.  This act shall take effect 60 days after its passage.
