AN ACT prohibiting a municipality or school district from compensating an employee on leave of absence.

ANALYSIS

 

This bill prohibits a public employee on leave of absence, sabbatical, or not directly employed by and working for the municipality or school district, from receiving any public employee benefit while on leave of absence.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT prohibiting a municipality or school district from compensating an employee on leave of absence.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; School Boards; Public Employee Benefits.  Amend RSA 189 by inserting after section 72 the following new section:

189:73  Public Employee Benefits.  A public employee shall receive public employee benefits negotiated in a collective bargaining agreement only when such employee is employed by and works for the municipality or school district.  A public employee on leave of absence, sabbatical, or not directly employed by and working for the municipality or school district, shall be ineligible to receive any public employee benefit while on leave of absence.  A public employee on leave of absence at the employee's own request, shall be ineligible to receive, purchase, or reimburse a municipality or school district for these benefits.  In this section, "public employee benefits" means salary or wages, medical or dental benefits, vacation leave, sick leave, or earn “step and track” salary advancement, or earned time toward benefits provided by the New Hampshire retirement system.

2  Effective Date.  This act shall take effect 60 days after its passage.
