STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT requiring school districts to establish policies relating to suspensions and expulsions.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Duties of State Board of Education; Suspension and Expulsion Policies; School Discipline.  Amend RSA 186:11 by inserting after paragraph XXXVII the following new paragraph:

XXXVIII.  School Discipline.  

(a)  Require each school district to establish a policy on school discipline that establishes the criteria for in-school suspensions, short term out-of-school suspensions, long term out-of-school suspensions and expulsions, and the maximum length of long term suspensions.  Such policy shall separately describe the criteria for imposition of each level of discipline, with reference to factors such as disruption of school activities, risk of property damage, actual or threatened bodily injury, or other factors determined relevant by the school district.

(b)  Require each school district to make its policy on school discipline available to parents at the beginning of each school year, along with a statement describing the procedural protections available to students subject to school discipline, and publicly available either on the district website or by providing a copy to the department of education, which shall publish it on its website.

2  Effective Date.  This act shall take effect 60 days after its passage.
