AN ACT relative to the removal of an elected treasurer.

ANALYSIS

 

This bill requires a town to remove an elected town treasurer from office after receiving a report from the department of revenue administration that the treasurer is not in compliance with his or her oath of office to honor the constitution.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to the removal of an elected treasurer.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Removal of Elected Town Treasurer.  Amend RSA 41:26-d by inserting after paragraph VI the following new paragraph:

VII.  If the department of revenue administration receives a complaint from an inhabitant of a town alleging that the elected town treasurer is not in compliance with his or her oath of office to honor the constitution under RSA 42:1, the department shall hold a hearing and issue a written report to such town within 45 days of receiving the complaint.  If the report states that the complaint is founded, the governing body of the town shall institute proceedings under paragraphs I-V to remove the elected treasurer from office.

2  Effective Date.  This act shall take effect 60 days after its passage.
