AN ACT requiring radon air testing on all new residential construction.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT requiring radon air testing on all new residential construction.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; State Building Code; New Construction; Radon Assessment.  Amend RSA 155-A by inserting after section 2 the following new section:

155-A:2-a  Radon Assessment of New Residential Construction.  A building inspector or other designated official shall not issue either a temporary or permanent occupancy permit for a new residential construction of a building under the state building code unless a radon assessment has been completed by a person qualified to test for the presence of radon in indoor air.  A copy of the results of the completed radon assessment shall be filed with the building inspector or designated official.

2  Effective Date.  This act shall take effect 60 days after its passage.
