STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eighteen
AN ACT relative to the Hampton Beach capital improvement fund.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Legislative Findings and Intent. The general court finds that a long history of collaboration between the state of New Hampshire and the town of Hampton has resulted in Hampton Beach being recognized regionally, nationally, and globally as a premiere vacation destination. State and local taxpayers made the Hampton Beach state park the crown jewel of the state park system, which in turn fuels the economy, generates government revenues, and adds to the quality of life for all people of our state. The legislature recognizes that both the state and the town of Hampton have a stake in and responsibility for enhancing the viability of Hampton Beach state park. The intent of this act is to build upon and strengthen the collaboration between the state of New Hampshire to the town of Hampton to enhance Hampton Beach state park.
2 Operation of Beach Parking Facilities. Amend RSA 216:3 to read as follows:
216:3 Operation of Beach Parking Facilities.
I. The department of natural and cultural resources shall operate, maintain, and manage the parking facilities at Hampton Beach, and shall be authorized to charge for the use of the parking facilities by meters or fees, including parking violation fines, whichever is determined most practical.
II. The state treasurer shall establish a special nonlapsing fund, which shall only lapse pursuant to paragraph III, for the revenues from the state parking facilities at Hampton Beach. Fifty percent of the payments for principal and interest of bonds and notes that are issued for the project of replacing the seawall in the Hampton Beach area shall be paid from this fund. Each fiscal year, the sum of [$200,000] $400,000 shall be transferred from this fund to the Hampton Beach capital improvement and maintenance fund established in paragraph IV.
III. The balance of any funds in this special nonlapsing fund shall be lapsed at the close of each fiscal year to the state park fund.
IV.(a) There is established a nonlapsing revolving fund to be known as the Hampton Beach capital improvement and maintenance fund in the department of natural and cultural resources. The revolving fund shall be used for capital improvements and capital equipment for the Hampton Beach-area state parks' parking and beach facilities, and for infrastructure, equipment, and maintenance expenses of the town of Hampton to support the Hampton Beach-area state parks' parking and beach facilities.
(b) The commissioner of natural and cultural resources shall submit a report detailing the activities of the revolving fund annually to the governor and council [and], the fiscal committee, the town of Hampton, and the Hampton Beach area commission within 60 days of the close of each fiscal year.
(c) The department of natural and cultural resources and the town of Hampton shall meet annually to review the report on activities of activities of the revolving fund. In the second year of each biennium, the department and town shall jointly prepare and submit recommendations to the governor, the speaker of the house of representatives, and the president of the senate, relating to expenditure of funds to support capital improvements and maintenance at Hampton Beach for the next biennium.
3 Application of Receipts. Amend RSA 6:12, I(b)(286) to read as follows:
(286) Moneys deposited into the Hampton Beach capital improvement and maintenance fund established under RSA 216:3, IV(a).
I. RSA 216:3, II as inserted by section 2 of this act shall take effect July 1, 2019.
II. The remainder of this act shall take effect July 1, 2018.

METHODOLOGY:
The Department of Natural and Cultural Resources indicates this bill would increase the amount deposited from the Hampton Beach Parking Meter Fund to the Hampton Beach Capital Improvement Fund from $200,000 to $400,000 per year, change the name of the Hampton Beach Capital Improvement Fund to the Hampton Beach Capital Improvement and Maintenance Fund, and reduce the amount of lapse to the State Park Fund at the end of each fiscal year by $200,000. The Hampton Beach Capital Improvement and Maintenance Fund would also be available for infrastructure, equipment, and maintenance expenses incurred by the town of Hampton to support the Hampton Beach-area State park facilities. The expenditures the Town would incur are not known therefor the impact on local revenue and expenditures is indeterminable. State restricted revenue and expenditures in total would not change; revenue and expenditures in the Hampton Beach Capital Improvement and Maintenance Fund would increase at the expense of the State Park Find.
