1 New Paragraph; New Hampshire Health Protection Program; Waiver Required. Amend RSA 126-A:5 by inserting after paragraph XXX the following new paragraph:

XXXI.(a) The commissioner shall seek a waiver to reduce eligibility from 138 percent to 100 percent of the poverty level to receive benefits under paragraphs XXIV-XXV and XXX. The commissioner shall also include in the waiver a provision ending retroactive eligibility under the New Hampshire health protection program. Prior to submitting the waiver to CMS, the commissioner shall present the waiver to the governor and the fiscal committee of the general court for approval.

(b) The commissioner shall develop and implement enhanced eligibility screening to stop payments in a timely manner to those persons who are no longer eligible to receive benefits under paragraphs XXIV-XXV and XXX. The commissioner shall also establish a method to recapture any payments which were made to ineligible persons.

2 Effective Date. This act shall take effect 60 days after its passage.
