AN ACT relative to facilities licenses for charitable gaming and relative to security requirements for games of chance.

AMENDED ANALYSIS

 

This bill:

 

I.  Allows the leasee of a building to apply for a facilities license.  

 

II.  Removes the requirement of a certificate of good standing from the department of revenue administration.

 

III.  Removes the limit on  facilities licenses that may be issued annually.

 

IV.  Requires lottery commission approval for additional security requirements for games of chance imposed by a local or state agency.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT relative to facilities licenses for charitable gaming and relative to security requirements for games of chance.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Facilities LIcense Application.  Amend RSA 287-D:7 to read as follows:

287-D:7  Facilities License Application; Specific Requirements.

I.  Any person or entity other than a charitable organization or governmental subdivision with control of a facility, including by a written lease, at which games of chance are held for 5 or more game dates per calendar year shall be licensed.

II.  In addition to the general requirements under RSA 287-D:5, a facilities license application shall include, at a minimum, the following information provided that the commission may, by rule, establish additional items to be submitted on the application form or attached to it:

(a)  Certification of compliance with all of the requirements of RSA 287-D:5.

[(b)  A certificate of good standing from the department of revenue administration.

(c)] (b)  Two passport quality photographs, if the applicant is an individual.

[III.  Only one facilities license shall be issued to each applicant per year.

IV.] III.  Licenses shall expire on December 31 of each year.

2  New Subparagraph; Games of Chance; Surveillance Requirements; Additional Security.  Amend RSA 287-D:15, III by inserting after subparagraph (f) the following new subparagraph:

(g)  No additional security requirements shall be imposed by any local or state agency without the approval of the commission.

3  Effective Date.  This act shall take effect 60 days after its passage.
