I.  Requires school employees to report crimes that would prevent a person from being hired as a teacher.

 

II.  Permits district school boards to grant certain exceptions to the prohibition on locating syringe service programs in a drug-free zone.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to safe school zones and relative to syringe service programs.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

254:1  Safe School Zones; Definitions.  Amend RSA 193-D:1, I to read as follows:

I.  "Act of theft, destruction, or violence'' means an act set forth in the following statutes regardless of the age of the perpetrator:

(a)  [Homicide under RSA 630] Any of the offenses enumerated in RSA 189:13-a, V.

(b)(1)  Any first or second degree assault under RSA 631.

(2)  Any simple assault under RSA 631:2-a.

(c)  [Any felonious or aggravated felonious sexual assault under RSA 632-A.

(d)]  Criminal mischief under RSA 634:2.

[(e)] (d) Unlawful possession or sale of a firearm or other dangerous weapon under RSA 159.

[(f)] (e)  Arson under RSA 634:1.

[(g)]  (f)  Burglary under RSA 635.

[(h)] (g)  Robbery under RSA 636.

[(i)] (h)  Theft under RSA 637.

[(j)]  (i)  Illegal sale or possession of a controlled drug under RSA 318-B.

[(k)] (j)  Criminal threatening under RSA 631:4.

254:2  Syringe Service Programs in Drug-Free School Zones Prohibited; Exceptions.  Amend RSA 318-B:45 to read as follows:

318-B:45  Syringe Service Programs in Drug-Free School Zones Prohibited.  No syringe service program shall be located within a drug-free school zone as defined in RSA 193-B:1, II.  Exceptions to this prohibition may be granted by the applicable district school board when a request is initiated by a syringe service program administrator.

254:3  Effective Date.  This act shall take effect 60 days after its passage.
