AN ACT relative to adoption of emergency medical and trauma services protocols.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to adoption of emergency medical and trauma services protocols.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Emergency Medical and Trauma Services; Powers and Duties of the Coordinating Board.  Amend RSA 153-A:4, VI to read as follows:

VI.  Approve statewide trauma policies[,] and procedures[, and protocols] of the statewide trauma system and the establishment of minimum standards for system performance and patient care proposed by the commissioner prior to their adoption under RSA 541-A and approve statewide trauma protocols prior to their adoption under RSA 153-A:20-a.

2  New Paragraph; Emergency Medical and Trauma Services Coordinating Board; Hearing Prior to Recommendation of Minimum Standards or Protocols.  Amend RSA 153-A:4 by inserting after paragraph VI the following new paragraph:

VI-a.  Prior to any final vote regarding minimum standards or protocols:

(a)  Provide notice of the proposed action to fire and emergency medical service members.

(b)  Allow a 60-day period for the receipt of written comments on the proposal.

(c)  Hold public hearings, one in the daytime hours and another during the evening hours, in such a way as to maximize input from fire and emergency medical service members.

3  Emergency Medical Services Medical Control Board; Submission of Protocols.  Amend RSA 153-A:5, III(d) to read as follows:

(d)  Submitting to the commissioner standardized protocols concerning patient care to consider for adoption as rules[,] pursuant to RSA 153-A:20-a, which shall be exempt from RSA 541-A and which shall address prerequisites within protocols governing their use by providers, living wills established under RSA 137-H, durable powers of attorney for health care established under RSA 137-J, and patient-requested, physician generated orders relative to resuscitation.

4  New Section; Emergency Medical and Trauma Services Protocols.  Amend RSA 153-A by inserting after section 20 the following new section:

153-A:20-a  Emergency Medical and Trauma Services Protocols.  The commissioner shall adopt rules, which shall be exempt from the provisions of RSA 541-A, relative to protocols approved and issued by the emergency medical services medical control board for provision of emergency medical care, which shall address living wills established under RSA 137-J, durable powers of attorney for health care established under RSA 137-J, and patient-requested, physician generated orders relative to resuscitation.

5  Repeal.  RSA 153-A:20, II, relative to adoption of emergency medical and trauma services protocols under RSA 541-A, is repealed.

6  Effective Date.  This act shall take effect 60 days after its passage.
