AN ACT relative to satellite dispensaries for therapeutic cannabis.

This bill allows the department of health and human services to authorize alternative treatment centers to establish a satellite dispensary for therapeutic cannabis.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to satellite dispensaries for therapeutic cannabis.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Use of Cannabis for Therapeutic Purposes; Departmental Rules.  Amend RSA 126-X:6 by inserting after paragraph III the following new paragraph:

IV.  The department may adopt rules establishing and regulating satellite dispensaries pursuant to 126-X:7, X including, but not limited to, fees for the operation of a satellite dispensary.

2  New Paragraph; Use of Cannabis for Therapeutic Purposes; Satellite Dispensaries.  Amend RSA 126-X:7 by inserting after paragraph IX the following new paragraph:

X.  If the department determines that having additional locations for the dispensing of therapeutic cannabis is necessary to adequately and effectively meet the needs of qualifying patients and designated caregivers, the department may authorize one or more alternative treatment centers to establish a satellite dispensary.  No alternative treatment center shall be authorized to establish more than one satellite dispensary.  Satellite dispensaries shall only be established in geographic locations approved by the department, shall be limited solely to the dispensing of cannabis and educational efforts, and shall not be used for cultivation or other activities relative to the production of cannabis.  Such satellite dispensaries shall be subject to rules adopted by the department.

3  Effective Date.  This act shall take effect 60 days after its passage.
