STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to votes by condominium unit owners.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Unit Owners' Associations; Voting.  Amend RSA 356-B:39, V to read as follows:

V.  If 50 percent or more of the votes in the unit owners' association [appertain to] are held by 25 percent or less of [the] owners of units or members of the same family, whether those owners hold title individually or in a limited liability company or corporation or trust, then in any case where a majority vote or larger percentage vote is required by the condominium instruments or by this chapter, the requirement for such a majority or larger percentage shall be deemed to include, in addition to [the specified] a majority of [the] total votes in the association, the assent by [the unit owners of a like] a majority of [the] owners of units holding the minority interest.

2  Effective Date.  This act shall take effect 60 days after its passage.
