AN ACT establishing a commission to study enhancing the prescription drug donation program.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eighteen
AN ACT establishing a commission to study enhancing the prescription drug donation program.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Commission to Study Enhancing the Program of Donating, Accepting, and Redispensing Unused Drugs. Amend RSA 318 by inserting after section 58 the following new section:
318:58-a Commission to Study Enhancing the Program of Donating, Accepting, and Redispensing Unused Drugs.
I. There is established a commission to study enhancing the program of donating, accepting, and redispensing unused drugs, established under RSA 318:58.
(a) The members of the commission shall be as follows:
(1) One member of the senate, appointed by the president of the senate.
(2) Three members of the house of representatives, appointed by the speaker of the house of representatives.
(3) The commissioner of the department of health and human services, or designee.
(4) The executive director of the New Hampshire Pharmacists Association, or designee.
(5) The executive director of the New Hampshire Providers Association, or designee.
(6) The executive director of AARP New Hampshire, or designee.
(7) A member of the New Hampshire High Tech Council's BioTech/MedTech Cluster, appointed by the council.
(8) A public member with experience providing access to affordable prescription drugs in under served communities, appointed by the governor.
(b) Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.
II.(a) The commission shall:
(1) Review the effectiveness of the program established under RSA 318:58, including, but not limited to, cost-savings to New Hampshire in terms of reduced Medicaid expenses for prescription drugs and medical devices, how many people have benefited from the program, whether it has increased affordability of prescription drugs and medical devices, and whether or not low-income persons, including seniors on fixed incomes benefit from the program;
(2) Review other state’s drug donation programs, including Iowa’s drug donation program, which is considered one of the most effective drug donation programs in the country;
(3) Recommend changes to enhance the program under RSA 318:58, including how to reduce New Hampshire’s Medicaid prescription drug and medical device costs and how to reach and provide more affordable access to prescription drugs and medical devices to more low-income persons, including seniors on fixed incomes; and
(4) Recommend the funding which may be needed in the next legislative budget should the general court choose to fund a coordination role for the department of health and human services.
(b) The commission may solicit input from any person or entity the commission deems relevant to its study.
III. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Five members of the commission shall constitute a quorum.
IV. The commission shall make a report, together with its findings and recommendations for legislation, on or before November 30, 2018 to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, the chairs of the senate and house finance committees, the chairs of the senate and house committees having jurisdiction over health and human services, and the state library.
2 Repeal. RSA 318:58-a, relative to a commission to study enhancing the program of donating, accepting, and redispensing unused drugs, is repealed.
I. Section 2 of this act shall take effect November 30, 2018.
II. The remainder of this act shall take effect upon its passage.
