ANALYSIS

 

This bill prohibits the university system and community college system from distributing state-funded financial assistance to any student who is not a legal resident of the United States.  The bill also limits the availability of adult education programs funded by state or local sources to legal residents of the state of New Hampshire.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT prohibiting the distribution of higher education and adult education financial assistance to any student who is not a legal resident.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; State College and University System; Prohibiting Disbursement of State Funds to Students Who Are Not Legal Residents.  Amend RSA 187-A by inserting after section 16-b the following new section:

187-A:16-c  Prohibiting Disbursement of State Funds to Students Who Are Not Legal Residents.  No institution of the university system shall distribute state-funded financial assistance to any student who has failed to demonstrate legal residency in the United States.

2  New Section; Community College System of New Hampshire; Prohibiting Disbursement of State Funds to Students Who Are Not Legal Residents.  Amend RSA 188-F by inserting after section 16-a the following new section:

188-F:16-b  Prohibiting Disbursement of State Funds to Students Who Are Not Legal Residents.  No institution of the community college system shall distribute state-funded financial assistance to any student who has failed to demonstrate legal residency in the United States.

3  Adult Education; Funding of Educational Programs.  Amend RSA 186:63 to read as follows:

186:63  Funding of Educational Programs.  Funding for the programs authorized by this subdivision shall be from monies appropriated by the state and the school districts for such programs and from such other funds as may be made available by the state board of education.  Educational programs authorized by this subdivision shall only be available to legal residents of the state of New Hampshire.  

4  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill prohibits the University System of New Hampshire (USNH) and the Community College System of New Hampshire (CCSNH) from distributing any state-funded financial assistance to any student who has failed to demonstrate legal residency in New Hampshire.  Additionally, this bill restricts non-legal residents of the state for adult education programs under RSA 186:61-63.  Both USNH and CCSNH have existing processes for determining legal residency and therefore this bill will have no impact on either system.  

 

The Department of Education provides programs for approximately 7,000 adults, but does not collect any information pertaining to the legal status of those served.  Therefore, it is not possible to estimate this bill’s impact on state expenditures, or local expenditures to the extent funds pass through school districts.
