AN ACT making appropriations to the department of education for adequate education grants and relative to certain provisions for Medicaid waivers.

AMENDED ANALYSIS

 

This bill makes an appropriation to the department of education to provide additional adequate education grants to certain municipalities.

 

This bill also modifies certain provisions for Medicaid waivers under the New Hampshire health protection program.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT making appropriations to the department of education for adequate education grants and relative to certain provisions for Medicaid waivers.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Appropriation; Department of Education; Additional Adequate Education Grants to Certain Municipalities.  The sum of $1,483,428 for the fiscal year ending June 30, 2018 is hereby appropriated to the department of education for the purpose of providing additional adequate education grants to certain municipalities as calculated in RSA 198:40-a and 198:41 in the amount of $684,498 for the fiscal year ending June 30, 2016 and $798,930 for the fiscal year ending June 30, 2017, specifically related to amounts calculated pursuant to RSA 198:40-a, II(e) which were not distributed to those municipalities in that fiscal year.  Said sum shall be a charge against the education trust fund established in RSA 198:39.  Notwithstanding RSA 198:42, the commissioner of the department of education shall disburse a lump sum to each municipality.

2  Department of Health and Human Services; New Hampshire Health Protection Program; Medicaid Wavier; Work Requirements.  Amend RSA 126-A:5, XXX(a)(5) to read as follows:

(5)  Any waivers or amendments pursuant to this subparagraph shall be in place by [April] June 30, 2018.  [Prior to submitting the waiver or state plan amendments to the CMS, the commissioner shall present the waiver or state plan amendments to the governor and the fiscal committee of the general court for approval.]  The program shall not be reauthorized until such waivers or state plan amendments have been approved by CMS.  If the waiver or state plan is not approved, the commissioner shall [immediately], no later than [April] June 30, 2018, notify all program participants that the program has not been reauthorized beyond December 31, 2018.

3  Effective Date.  This act shall take effect upon its passage.

METHODOLOGY:

This bill makes an appropriation of $1,483,428 in FY 2018 for the Department of Education to provide additional adequate education grants to certain municipalities.  The additional funding, $684,498 for FY 2016 and $798,930 for FY 2017, is specifically related to amounts calculated for differentiated aid attributable to each third grade pupil in the average daily membership with a score below the proficient level on the reading component of the state assessment, which was not distributed in those fiscal years.  The appropriation will be a charge against the education trust fund.  See table below for amount for each municipality.
