STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT repealing the licensing requirement for open-air shows and repealing the laws related to the keeping of billiard tables.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Repeal.  The following are repealed:

I.  RSA 286:1, relative to the license requirement for showmen and similar performers.

II.  RSA 286:5, relative to the penalty for violation of certain requirements for open-air shows.

III.  RSA 286:6-11, relative to municipal licenses for billiard tables.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill repeals the laws requiring local licensing of showmen and similar performers, billiard tables, pool tables and bowling alleys.  It also repeals associated penalties as well as the penalty for violations of certain requirements for open-air shows.  The New Hampshire Municipal Association states it appears that many municipalities either do not enforce the existing license requirements, charge only a nominal fee, or charge no fee.  The Association is unable to obtain exact numbers but states it appears the bill would lead to a small, but indeterminable decrease in revenue for some municipalities.  There should be no effect on municipal expenditures.

 

The Judicial Branch indicated in 2017 there may be savings to the Branch due to less cases having to be brought to court involving the repeal of penalties involving unspecified misdemeanors for a natural person (RSA 286:5), felony for all other persons (RSA 286:1-4), and violations pursuant to RSA 286:10 for operating without a license.  Only 6 cases in the prior 10 fiscal years (2008-2017) have been brought pursuant to the relevant statutes.  The Judicial Branch concluded that the bill will have a small but indeterminable fiscal impact.
