AN ACT relative to leased railroad property.

ANALYSIS

 

This bill requires the commissioner of the department of transportation to notify the municipality in which state-owned rail property is located of any lease of such property.

 

This bill also requires the lessee of state-owned rail property to meet the same municipal regulatory and safety requirements as private property owners.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT relative to leased railroad property.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Transportation; Lease of State-Owned Rail Property.  Amend RSA 228:57 to read as follows:

228:57  Sale or Lease; Purpose.

I.  The commissioner as sole agent for the state, with the approval of the governor and council, is authorized to sell, transfer or lease all or any part of the rail properties, and other property acquired under the provisions of this subdivision, to any responsible person, firm or corporation, for continued operation of a railroad, or other public use, provided, if necessary, approval for such continued operation, or other public use, is granted by the interstate commerce commission of the United States whenever such approval is required.  Such sale, transfer or lease shall be for such price, and subject to said further terms and conditions, as in the opinion of the commissioner are necessary and appropriate to effectuate the purposes of this subdivision.

II.  The commissioner shall notify a municipality of the lease of any state-owned rail property located within the municipality at least 15 days before such lease is signed or amended.

III.  Any lessee of state-owned rail property shall meet the same municipal regulatory and safety requirements as private property owners.

2  Effective Date.  This act shall take effect 60 days after its passage.
