STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nineteen
AN ACT establishing reciprocity for notaries in adjacent states.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Notary Public; Application; Nonresidents. Amend RSA 455:2 to read as follows:
455:2 Application. Any person applying to be a notary public shall be a resident of this state or a resident of an adjacent state. The applicant shall sign a written statement under oath as to whether the applicant has ever been convicted of a crime that has not been annulled by a court, other than minor traffic violations. The applicant shall be endorsed for appointment by 2 notaries public and a registered voter of this state. A nonresident may be commissioned as a notary public in New Hampshire provided that the individual submits to the secretary of state: (i) the notary application fee required under RSA 5:10 and (ii) an affidavit stating that the individual is a resident of an adjacent state and is a registered notary in such state.
2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill would permit reciprocity for notaries public from adjacent states by allowing such nonresidents to be commissioned as a notary public in New Hampshire upon submission of an affidavit confirming status as a notary in the adjacent state and payment of the current $75 fee. Pursuant to RSA 5:10-b, $25 of the current fee is dedicated to the notary fund (notary fee account) for the printing of manuals and enforcement and $50 goes to the general fund. The Secretary of State's Office indicates there are currently 23,072 commissioned notaries in New Hampshire. The Office cannot estimate how many additional notaries will become commissioned and pay the $75 fee due to the passage of this legislation, therefore the additional revenue is indeterminable.
