This bill excludes emergency response and training by retired members working for municipal fire departments from the limitations on part-time employment by retired members in the retirement system.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT relative to the limitations on part-time employment under the New Hampshire retirement system.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Retirement System; Part-time Employment; Emergency Exceptions.  Amend RSA 100-A:7-b to read as follows:

100-A:7-b  Certain Part-Time Employment; Emergency Exception.  The annual limitations on part-time employment as defined in RSA 100-A:1, XXXIV shall be modified for retired members to exclude any hours worked during an emergency under this section.  For purposes of this section, an emergency includes any event declared by the governor or while working under the direction of the director of the division of forests and lands during woodland fire control, and emergency response and training by retired members working for municipal fire departments.  Employers shall include hours worked during an emergency as a separate entry in the report required in RSA 100-A:16, VII(a).

2  Effective Date.  This act shall take effect 60 days after its passage.

*The New Hampshire Retirement System states it is not able to separate the fiscal impact of this legislation between county and local government, therefore the fiscal impact is shown together as political subdivisions.

 

METHODOLOGY:

This bill  excludes emergency response and training by retired members working for municipal fire departments from the annual limitations on part-time employment.  The New Hampshire Retirement System states an individual could currently lose the annuity portion of their pension if the person exceeds the cap on hours allowed.  This bill would exclude hours worked under the definitions outlined in the bill, thereby benefitting the individual by avoiding the possible loss of the annuity portion of such pension.  The possible loss of such pension amounts currently represent a possible savings of expense to the NHRS.  The bill may eliminate such savings. The possible change in expense and savings to the NHRS is not likely to affect employer rates significantly, but such fiscal impact is indeterminable.  There is no revenue impact to the system as there are no contributions collected on behalf of such retired individuals.
