ANALYSIS

 

This bill requires the state board of education to adopt rules requiring the state board and each school district in the state to develop and implement a conflict of interest policy.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT requiring school boards to establish conflict of interest policies.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; State Board of Education; Duties.  Amend RSA 186:11 by inserting after paragraph XXXVII the following new paragraph:

XXXVIII.  Conflict of Interest.  Adopt rules pursuant to RSA 541-A requiring the state board of education and the school board of each school district to develop and implement a conflict of interest of policy governing the activities of the members of the school board and school district administration.  The policy shall, at a minimum, include provisions for reporting alleged conflicts of interest to the school board, investigation of such reports, and recommended actions to be taken or sanctions imposed to resolve the matter.  A school board that has an existing conflict of interest policy shall amend such policy to comply with the requirements of this paragraph.

2  Effective Date.  This act shall take effect 60 days after its passage.
