STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nineteen
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Condominium Act; Enforcement. Amend RSA 356-B:48 to read as follows:
356-B:48 Administration; Enforcement.
I. The provisions of this chapter shall be administered and enforced by the consumer protection and antitrust bureau, department of justice, established in RSA 21-M:9.
II. In addition to the oversight and enforcement of condominium requirements in this subdivision, the consumer protection and antitrust bureau shall receive complaints of unit owners and, if necessary, resolve the complaints through investigation, mediation, informal resolution, issuance of a cease and desist order under RSA 356-B:61, or other suitable means. The attorney general shall, on or before December 1 of each year, file a report with the committee to study laws relating to condominium and homeowners' associations established in RSA 356-B:70 detailing the number of complaints received and the actions taken.
2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill requires the Department of Justice, consumer protection and antitrust bureau, to receive and resolve, if necessary, complaints of unit owners of condominiums. The Department of Justice assumes it would need a full-time attorney and a full-time investigative paralegal to satisfy the responsibilities of this bill. The Department estimates the following costs for the additional positions, benefits, office furnishing and other operating expenses: $186,000 in FY 2020, $190,000 in FY 2021, $195,000 in FY 2022 and $201,000 in FY 2023.
