AN ACT relative to the release of motor vehicle records.

ANALYSIS

 

This bill amends the definition of motor vehicle records and clarifies the circumstances under which certain information contained in motor vehicle records may be released to the public.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT relative to the release of motor vehicle records.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Administration of Motor Vehicle Laws; Records and Certification.  Amend RSA 260:14, I(a) to read as follows:

(a)  "Motor vehicle records" means all applications, reports required by law, registrations, histories, certificates, and licenses and nondriver's picture identification cards issued or revoked by the department relative to motor vehicles and the information, including personal information, contained in them.

2  Administration of Motor Vehicle Laws; Records and Certification.  Amend RSA 260:14, VIII to read as follows:

VIII.(a)  Nothing in this section shall prohibit the department or a law enforcement agency of a political subdivision in its discretion from releasing to the public any person's name, age or motor vehicle offenses only.

(b)  Nothing in this section shall prohibit the commissioner in his or her discretion from releasing to the public any person's name, age, height, weight, eye color, photograph, or computerized image in matters of personal or public safety.

3  Effective Date.  This act shall take effect upon its passage.
