AN ACT establishing a committee to study the long-term sustainability of the drinking and groundwater trust fund.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT establishing a committee to study the long-term sustainability of the drinking and groundwater trust fund.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Committee Established.  There is established a committee to study the sustainability of the drinking water and groundwater trust fund.  

2  Membership and Compensation.

I.  The members of the committee shall be as follows:

(a)  One member of the senate, appointed by the president of the senate.

(b)  Two members of the house of representatives, one appointed by the speaker of the house of representatives and one appointed by the house minority leader.

II.  Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

III.  The committee shall solicit advice and testimony from the following organizations, entities, and individuals and any other individual or organization with information relevant to the committee's study:

(a)  The state treasurer.

(b)  The commissioner of the department of environmental services.

(c)  One representative of a state or regional land trust.

(d)  One representative of the New Hampshire Water Works Association.

(e)  One representative of the New Hampshire Association of Conservation Commissions.

(f)  A member of the public who has business experience related to the creation and/or delivery of clean and safe drinking water.

(g)  A member of the public who represents citizens receiving their drinking water from private wells.

(h)  A municipal official from a municipality without a public drinking water system.

(i)  Any other stakeholders, nonprofit organizations and other parties with an interest in the purpose of the water supply land protection grant program.

3  Duties.  The committee shall:

I.  Study the extent to which water supply land is unprotected from contamination.

II.  Anticipating a draw down in funding, study the following about the programs administered by the drinking water and groundwater trust fund under RSA 485-F:3:

(a)  How much money has been used historically to fund programs.

(b)  How such money was used historically.

(c)  The sustainability of such funding levels and programs.

4  Chairperson; Quorum.  The members of the study committee shall elect a chairperson from among the members.  The first meeting of the committee shall be called by the first-named senate member.  The first meeting of the committee shall be held within 45 days of the effective date of this section.  Three members of the committee shall constitute a quorum.

5  Report.  The committee shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2019.

6  Effective Date.  This act shall take effect upon its passage.
