STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nineteen
AN ACT establishing a commission to study incidents of workplace violence against state employees.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; Department of Labor; Commission to Study Violence by the Public Against State Employees. Amend RSA 273 by inserting after section 28 the following new subdivision:
Commission to Study Acts of Violence by the Public Against State Employees
273:28-a Commission Established.
I. There is established a commission to study acts of violence by the public against New Hampshire state employees and to recommend processes and policies to reduce future incidents of violence in the workplace. The members of the commission shall be as follows:
(a) One member of the senate, appointed by the president of the senate.
(b) Two members of the house of representatives, appointed by the speaker of the house of representatives.
(c) One member appointed by the governor.
(d) One member appointed by the chief justice of the New Hampshire supreme court.
(e) The commissioner of the department of administrative services, or designee.
(f) The commissioner of the department of health and human services, or designee.
(g) The commissioner of the department of safety, or designee.
(h) The executive director of the fish and game department, or designee.
(i) The commissioner of the department of revenue administration, or designee.
(j) The commissioner of the department of education, or designee.
(k) The president of the State Employees Association, SEIU Local 1984, or designee.
(l) The president of the Teamsters Local 633, or designee.
(m) The president of the New Hampshire Trooper’s Association, or designee.
(n) The president of the New England Police Benevolent Association, or designee.
II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.
III. The commission shall:
(a) Review past history of incidents of violence in the workplace that have been instigated by citizens against public employees.
(b) Review current policies to provide public employee safety in the workplace to determine effectiveness, timeliness, and protocol for anticipating deficiencies.
(c) Review other states' workplace safety policies including, but not limited to, New York’s public employer workplace violence prevention programs.
(d) Recommend changes to current policies to reduce workplace violence.
IV. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Six members of the commission shall constitute a quorum.
V. The commission shall submit a report, including findings and recommendations for legislation, on or before November 1, 2019 to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library.
2 Repeal. RSA 273:28-a, relative to a commission study acts of violence by the public against New Hampshire state employees, is repealed.
I. Section 2 of this act shall take effect November 1, 2019.
II. The remainder of this act shall take effect upon its passage.
