AN ACT adding a member to the New Hampshire community development advisory committee and exempting the community development finance authority from the administrative procedure act.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT adding a member to the New Hampshire community development advisory committee and exempting the community development finance authority from the administrative procedure act.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

299:1  The New Hampshire Community Development Advisory Committee.  Amend RSA 162-L:15, II to read as follows:

II.  The committee shall consist of [10] 11 voting members as follows:

(a)  The chairperson of the board of directors of the community development finance authority, or designee, who shall serve as chairperson of the committee.

(b)  The director of the office of strategic initiatives, or designee.

(c)  The executive director of the New Hampshire housing finance authority, or designee.

(d)  The director of the division of economic development, department of business and economic affairs, or designee.

(e)  The executive director of a regional development organization, appointed by the governor.

(f)  Six public members, at least 3 of whom shall be municipal officials, who shall be appointed by and serve at the pleasure of the governor.

299:2  New Subparagraph; Administrative Procedure Act; Exemptions; Community Development Finance Authority Added.  Amend RSA 541-A:21, I by inserting after subparagraph (jj) the following new subparagraph:

(kk)  RSA 162-L, relative to the community development finance authority.

299:3  New Sections; Community Development Finance Authority; Exemption From Administrative Procedure Act and Rulemaking Authority.  Amend RSA 162-L by inserting after section 4 the following new sections:

162-L:4-a  Exemption From Administrative Procedure Act and Rulemaking Authority.  The authority shall be exempt from the provisions of RSA 541-A and may adopt rules in accordance with its own procedures to facilitate, implement, and carry out the powers, duties, and purposes of the authority enumerated in this chapter and such other and additional powers and purposes as shall be conferred upon it.

162-L:4-b  Relation to Other Agencies.  The financial and administrative operations of the authority shall be exempt from the rules of any department, commission, board, bureau, or agency of the state except to the extent and in the manner provided in this chapter.

299:4  Community Development Finance Authority; Community Development Block Grant Program; Reference Change.  Amend RSA 162-L:17, IV and V to read as follows:

IV.  The authority shall solicit applications from eligible municipalities.  Any eligible municipality desiring to receive funds under this subdivision shall complete and submit an application in accordance with the rules adopted [under RSA 162-L:16] by the authority.  

V.  The authority shall evaluate the relative merits of the applications based on the rules, criteria, and procedures adopted [under RSA 162-L:16] by the authority.

299:5  Repeal.  RSA 162-L:16, IV, relative to the adoption of rules under the administrative procedure act, is repealed.

299:6  Effective Date.  

I.  Section 1 of this act shall take effect 60 days after its passage.

II.  The remainder of this act shall take effect upon its passage.
