STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nineteen
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Appropriation. Notwithstanding RSA 126-AA:2, I(a) and RSA 126-AA:3, the sum of $3,000,000 for the fiscal year ending June 30, 2019 is hereby appropriated to the department of health and human services for the purpose of enhancing provider rates for mental health and substance misuse inpatient and outpatient services consistent with 2018, 342. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated. If any portion of said sum is not used for the purpose herein, it shall lapse to the general fund. The commissioner of the department of health and human services shall issue a report to the finance committees of the senate and the house of representatives stating how he intends to spend the appropriation within 21 days of passage of this act. Notwithstanding RSA 14:30-a,VI, the department is hereby authorized to accept and expend any federal fund match to the appropriation in this section without prior approval of the fiscal committee.
2 Department of Health and Human Services; Emergency Shelter and Stabilization Services.
I. The sum of $450,000 in general funds is hereby appropriated to the department of health and human services for the fiscal year ending June 30, 2019, which shall be nonlapsing, for the purpose of emergency shelter and stabilization services for persons experiencing substance misuse. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated. Notwithstanding RSA 14:30-a, VI, the department is hereby authorized to accept and expend any federal fund match to the appropriation in this section without prior approval of the fiscal committee of the general court.
II. The commissioner of the department of health and human services shall allocate and disburse such funds through a sole source contract or contracts and shall prioritize the use of the funds to high need areas within the state of New Hampshire that are in immediate need for those services. The contracted services shall be operational on or before June 30, 2019.
3 Effective Date. This act shall take effect upon its passage.

METHODOLOGY:
This bill makes a general fund appropriation of $3,450,000 to the Department of Health and Human Services in FY 2019. Of the appropriation, $3,000,000 is for the purpose of enhancing provider rates for mental health and substance misuse services and $450,000 is for the purpose of emergency shelter and stabilization services. The $450,000 portion is nonlapsing.
The $3,000,000 for provider rates will be eligible for matching federal funds, but since the appropriation will fund services for individuals in both the traditional Medicaid population (50% federal funds) and the Granite Advantage Health Care population (93% federal funds), the Office of the Legislative Budget Assistance is currently unable to determine the amount of federal dollars that will be received.
