STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty
Be it Enacted by the Senate and House of Representatives in General Court convened:
151:10-a Hospital Merger Advisory Commission Established.
I.(a) There is established a hospital merger advisory commission. The members of the commission shall be as follows:
(1) Five members of the house of representatives, appointed by the speaker of the house of representatives.
(2) Two members of the senate, appointed by the majority leader of the senate.
(3) The commissioner of the department of health and human services, or designee.
(4) The director of charitable trusts, or designee.
(5) The insurance commissioner, or designee.
(6) Two members of the public appointed by the governor, speaker of the house of representatives, and senate president.
(7) A public member representing each community where a hospital that is proposed to be merged with another hospital is located, appointed by the board of selectmen or city council.
(b) Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.
II.(a) The commission shall monitor proposals to merge, and the mergers of, hospitals and other health care institutions in the state. The commission shall gather information on how such proposed transactions or actual transactions impact health care, the operations of charitable trusts and the community or communities which are served by those institutions, including the community's or communities' need for access to quality and affordable physical and mental health care services.
(b) The commission shall advise the general court and relevant state agencies relative to necessary legislation or rules to ensure such mergers are in the public interest.
(c) The commission may solicit input from any person or entity the commission deems relevant to its study.
III. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Five members of the commission shall constitute a quorum.
IV. The commission shall submit an annual report, commencing on November 1, 2020, and a final report on or before November 1 2025, of its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library.
I. Section 2 of this act shall take effect November 1, 2025.
II. The remainder of this act shall take effect upon its passage.
