AN ACT permitting qualified patients visiting from out-of-state to access New Hampshire therapeutic cannabis dispensaries.

ANALYSIS

 

This bill permits out-of-state residents qualified in their home state to purchase therapeutic cannabis at New Hampshire therapeutic dispensaries.  This bill also establishes a penalty of $5 per cannabis plant for a qualifying patient who possesses 3 or fewer plants.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT permitting qualified patients visiting from out-of-state to access New Hampshire therapeutic cannabis dispensaries.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Use of Cannabis for Therapeutic Purposes; Therapeutic Use of Cannabis Protections.  Amend RSA 126-X:2, V(b) to read as follows:

(b)  A visiting qualifying patient shall not cultivate [or purchase] cannabis in New Hampshire or obtain cannabis from [alternative treatment centers or from] a qualifying New Hampshire patient.

2  New Paragraph; use of Cannabis for Therapeutic Purposes; Exception.  Amend RSA 126-X:2 by inserting after paragraph II the following new paragraph:

II-a.  Notwithstanding any provision of law to the contrary, a qualifying patient who possesses 3 or fewer cannabis plants shall be guilty of a violation not to exceed $5 per plant or a maximum penalty of $15.

3  Effective Date.  This act shall take effect 60 days after its passage.
