ANALYSIS
This bill allows for the limited restoration of driving privileges for a person whose license has been suspended after refusing to consent to a test to determine whether such person was driving or operating under the influence. The bill also grants discretion to courts to determine whether such persons shall be subject to the ignition interlock program for the duration of the privilege.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty
AN ACT relative to limited driving privilege after operating under the influence revocation or suspension.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Drivers' Licenses; Limited Driving Privilege After Revocation or Suspension. Amend the introductory paragraph of RSA 263:57-b, I to read as follows:
I. Notwithstanding any provision of law to the contrary, if a person is convicted of a first offense under RSA 265-A:2, I, not including any conviction involving driving a commercial motor vehicle, or if a person has had his or license suspended pursuant to RSA 265-A:14, I, he or she may petition the court for limited driving privileges. To qualify for consideration, the person shall submit proof of financial responsibility in accordance with RSA 265-A:28 and an application that demonstrates the need for the license. Satisfactory evidence of at least one of the following must be presented, including satisfactory proof from the employer, program, medical treatment facility, state-approved educational institution, or other destination:
2 Driver's Licenses; Limited Driving Privilege After Revocation or Suspension. Amend RSA 263:57-b, VI to read as follows:
VI. If the court determines it appropriate and as a condition of receiving a limited privilege license, the person shall agree to be subject to the ignition interlock program for the duration of the limited privilege and one year immediately following full restoration of driving privileges.
3 Effective Date. This act shall take effect 60 days after its passage.
