STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty
AN ACT establishing a surcharge for certain single use plastics.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; Single-Use Plastic User Surcharge. Amend RSA 149-M by inserting after section 60 the following new subdivision:
Single-Use Plastic User Surcharge
149-M:61 Definitions. In this subdivision:
I. "Single-use plastics" means a single-use, disposable object made predominantly of plastic derived from either petroleum or a biologically based polymer, used to transfer a beverage from a container to the mouth of a person drinking the beverage.
II. "Merchant" means any business that offers items for sale at retail.
149-M:62 Single-Use Plastic Use Surcharge. In order to encourage the use of reusable cups and bags instead of single-use plastic cups and bags, a merchant may charge $0.05 per single-use plastic cup and single-use plastic bag. The merchant shall keep the collected surcharge. Single-use plastic bags that are used for bulk items, to prevent the leaking of food items, and packages of multiple bags or beverage containers shall be exempt from the surcharge.
2 Effective Date. This act shall take effect one year after its passage.
