1 New Subparagraphs; Pesticides Controls; Certain Pesticides Prohibited. Amend RSA 430:41, I by inserting after subparagraph (e) the following new subparagraphs:

(f) Pesticides classified as carcinogenic, likely to be carcinogenic, or where suggestive evidence of carcinogenic potential exists from the United States Environmental Protection Agency.

(g) Pesticides classified in Group 1, Group 2A, or Group 2B by the International Agency for Research on Cancer.

(h) Orthophosphate pesticides.

430:58 Working Group on Alternatives to Highly Toxic and Carcinogenic Pesticides Established.

I. The department of agriculture, markets, and food shall establish in consultation with other state agencies, universities, cooperative extension offices, scientists, farmers, nongovernmental organizations, and other relevant experts and organizations a working group on alternatives to highly toxic and carcinogenic pesticides with the purpose of assisting any industries or sectors identified by the department as in need of alternative pest management strategies to shift away from highly toxic or carcinogenic pesticides, including but not limited to those pesticides prohibited under RSA 430:41, I(f)-(i).

II. The working group shall consist of 15 members, appointed by the commissioner of the department of agriculture markets, and food, who have expertise in alternative methods of pest management that do not use pesticides.

III. The working group shall elect a chairperson from its membership, and any other officers it deems necessary. The terms of members shall be 3 years. In the event of a vacancy, a new member shall be appointed for the unexpired term in the same manner as the original appointment. The first meeting of the working group shall be called by the first-named member. The first meeting of the working group shall be held within 6 months of the effective date of this section. Seven members of the working group shall constitute a quorum. The working group shall meet at least 6 times annually, and from time to time at the call of the chairperson or upon the request of any 5 members. All members of the working group shall disclose to the commissioner of the department of agriculture, markets, and food any potential conflicts of interest.

IV. The working group shall publish fact sheets, guidelines, videos, and conduct any other relevant form of outreach, focused primarily on non-pesticide alternative methods of pest management, made available on the Internet websites of collaborating state agencies.

V. The working group shall report at least annually to the governor, speaker of the house of representatives, president of the senate, clerk of the house of representatives, clerk of the senate, and state library. The annual report shall be posted on the general court website.

3 Effective Date. This act shall take effect 180 days after its passage.
