1 New Section; Ophthalmic Dispensers; Advisory Council. Amend RSA 327-A by inserting after section 4 the following new section:

327-A:4-a Advisory Council; Establishment, Duties. There is hereby established an advisory council to the executive director on the dispensing of spectacles, eyeglasses and contact lenses, whose members shall be appointed by executive director with the approval of the governor and council. The members of the advisory council shall consist of 4 registered opticians and one member of the public having no relationship to ophthalmic dispensing. The executive director shall designate one member of the advisory council as chairperson. Each member of the advisory council shall serve a 3 year term, except that for the initial council 2 of the optician members shall serve a 2 year term. The advisory council shall meet at least once each calendar quarter to conduct its business and more often on call of the chairperson. Three members of the council shall constitute a quorum to conduct business. Members of the advisory council shall receive no per diem but shall be entitled to mileage when in the performance of duties required by this chapter. The advisory council shall advise the executive director on general and specific policies involved in the dispensing of ophthalmic devices and contact lenses, including but not limited to consumer complaints.

2 Effective Date. This act shall take effect 60 days after its passage.
